Terms of Service: Uncommitted University

Welcome to Uncommitted University ("UU," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, application, and related services (collectively, the "Service"), which provide athlete branding, recruiting-support, and coach-outreach tools for high school, JUCO, NAIA, and transfer-portal baseball and softball athletes.
These Terms are a binding contract. By checking the box presented at sign-up, creating an account, or otherwise using the Service, you agree to them. If you do not agree, do not use the Service. Read them alongside our Privacy Policy, which explains how we collect and use information, and which is incorporated into these Terms by reference.
Section 16 contains a binding arbitration agreement and a class-action waiver that affect how disputes between us are resolved. Please read it carefully.
1. Why This Document Is Called “Terms of Service”
UU is not a static publication. It is an active service: we host your account, store and display content you create, run software on your behalf to draft outreach, process recurring payments, and maintain a directory you interact with. That ongoing, reciprocal relationship is governed by Terms of Service rather than the "Terms of Use" appropriate to a passive, read-only website. Visitors who merely browse public pages without an account are also bound by these Terms to the extent they apply to that browsing.
2. Eligibility & Minors
The Service is intended for student-athletes, their parents and legal guardians, and coaches whose professional program information appears in our directory.
- You must be at least 13 years old to use the Service. Individuals under 13 are not permitted to create an account, claim a profile, or submit any information, and we do not knowingly permit it.
- If you are between 13 and 17, you may use the Service only with the knowledge and permission of a parent or legal guardian. By using the Service you confirm that you have that permission, and that your parent or guardian has had the opportunity to review these Terms and the Privacy Policy.
- A parent or legal guardian who creates or supervises an account for a minor represents that they have authority to do so, accepts these Terms on the athlete's behalf, and may contact us at any time to review, correct, or delete the athlete's information.
- We may suspend or close any account we reasonably believe belongs to a person under 13, and will delete the associated information.
3. The Service
UU provides:
- A free, publicly browsable directory of college programs and coaching staff
- Free athlete profile pages usable as a recruiting-branding tool
- Free tools, including an eligibility calculator and level-finder
- Optional paid membership tiers offering enhanced branding, AI-assisted coach outreach drafting, contact tracking, and activity analytics
- Optional browser push notifications, if you turn them on
- Optional connections to Google/Gmail and X, so you can send outreach you have approved from your own address or handle without leaving the app (Section 7)
Coaches are never charged. The directory is free to browse, and we do not sell access to athlete data to coaches, recruiters, programs, or anyone else. Our revenue comes from athlete subscriptions only.
You always write and approve the message. UU never sends anything you have not read and approved, never sends on a schedule, and never sends in bulk on your behalf. If you do not connect an account, UU has no access to any mailbox or social account, you copy the draft and send it yourself, and the Service works fully that way.
Paid tiers, current pricing, and included features are described at uncommittedu.com. We may change tier features or pricing prospectively; changes will not retroactively alter a subscription term you have already paid for.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@uncommittedu.com if you suspect unauthorised use. You agree to provide accurate information when creating your account and profile, and to keep it current.
5. Subscriptions, Billing & Cancellation
- Paid tiers may include an initial fee plus a recurring subscription charge, as described at checkout before you pay.
- Subscriptions renew automatically each billing period until you cancel. We will tell you the renewal amount and date before each renewal where the law requires it.
- You may cancel at any time from your account settings, in the same place and with no more steps than it took to subscribe. Cancellation takes effect at the end of the current billing period.
- You keep what you paid for. Cancelling does not cut off access mid-term: you retain paid features through the end of the period you have already paid for, and are not billed again.
- Lifetime purchases are final and do not renew.
- Prices may change with advance notice; continued use after a price change accepts the new price for future billing cycles only.
Refunds. New members are covered by our 30 Day Guarantee, set out in Section 5A below. Outside that guarantee, and except where a refund is required by law, fees are non-refundable, including for partial-period cancellation, non-use, or dissatisfaction with recruiting outcomes. We will honour any refund right that applies to you under the law of your state, and we will correct billing errors. If you believe you were charged in error, contact support@uncommittedu.com and we will investigate.
5A. Our Guarantees
We advertise two guarantees. This section is the full text of both. Nothing in our marketing adds to them or takes anything away from them, and if anything we publish ever conflicts with this section, this section governs.
5A.1 The 30 Day Guarantee
Who it covers. Any individual member who makes a first paid purchase of The Recruit or The Commit, on any billing plan, including Lifetime. It applies once per person and once per household. It does not apply to a renewal, to a plan upgrade or downgrade, to a prepaid additional year purchased as an add-on, or to team or club accounts, which are sold under a separate written agreement.
The claim window. Your request must reach us within 30 calendar days of the date of your first payment, which is the date shown on the receipt Stripe emails you. The window runs from that payment date, not from the date you first sign in and not from the date you first use the Service. Requests received after 30 calendar days are outside this guarantee, though your rights under Section 5 and under your state's law are unaffected.
How to claim. Email support@uncommittedu.com from the address on the account, and say you want your money back. You do not have to give a reason, fill in a form, complete any minimum usage, return anything, or speak to anyone. We will not require you to take a call before issuing the refund.
What we refund. We refund everything you paid on that purchase, including the one time enrollment fee where one applied, and including any sales tax we collected. There is nothing you paid on that purchase that we keep.
Method. The refund is issued to the original payment method, through Stripe, as a reversal of the original charge. We do not issue account credit, vouchers, or store credit in place of a refund, and we do not require you to accept one. We aim to submit the refund within 5 business days of receiving your request. Once submitted, how quickly it appears on your statement is set by your bank or card issuer and is outside our control, typically 5 to 10 business days.
What happens to your account. Your paid membership ends when the refund is issued and you will not be billed again. Your profile is not deleted. Your account moves to the free plan and Section 5A.2 applies to it from that moment.
One condition, stated plainly. This guarantee exists so a family can try the Service without risk. It is not available where an account has been suspended or terminated for a breach of Section 6, Acceptable Use, and it does not survive repeated purchase and refund cycles by the same person.
5A.2 The Keep Your Work Guarantee
The promise. When your paid membership ends, for any reason and at any time, we do not delete what you built. Your account moves to the free plan and stays open.
Concretely, and this is the complete list of what stays available to you on the free plan:
- Your athlete profile and every field of information in it, including your headshot, your highlight video link, your measurables and your academic details.
- Your public athlete page at the same address it always had. The link you already gave to coaches keeps working, and coaches can still open it.
- Your control over that page. You can still edit every field and still choose, field by field, what is publicly visible.
- Your recruiting checklist and the progress recorded against it.
- Your saved target list of schools.
- Our free tools, the eligibility calculator and the level finder, which are free to everyone and always have been.
What you do not keep, stated with equal clarity. Ending a paid membership ends access to the paid features: college coach contact details, the member courses, the outreach analytics dashboard, and AI assisted outreach drafting. Your past outreach records are retained and are visible again if you resubscribe, but you cannot see them on the free plan.
How long. For as long as your account remains open. We do not delete a free account for inactivity, and we do not put an expiry date on your profile. If we ever change that, we will tell you first and give you a reasonable opportunity to ask us for a copy of your information under Section 12.
Deleting it yourself. Keeping your work is your choice, not an obligation. You may ask us to delete your account and everything in it at any time by writing to support@uncommittedu.com, and we handle that request as described in the Privacy Policy.
What this section is not. It is a commitment about access to your account. It is not a promise that the Service, or any individual feature of it, will be offered forever, and it does not limit our rights under Section 14, Termination, where an account has breached these Terms.
6. Acceptable Use
You agree not to use the Service to:
- Send unsolicited bulk messages unrelated to legitimate recruiting outreach, or otherwise abuse the outreach tools to spam coaches or programs
- Misrepresent your identity, age, athletic record, or academic information
- Impersonate another athlete, coach, parent, or program
- Attempt to access another user's account or data without authorisation
- Scrape, crawl, harvest, reverse-engineer, or bulk-export the coach and school directory or any other part of the Service, whether manually or by automated means
- Upload or generate synthetic, manipulated, or deepfake media depicting any real person, or content that harasses, demeans, or endangers another athlete
- Upload content you do not have the rights to, or that infringes anyone's intellectual property
- Use the Service in violation of applicable recruiting rules, including NCAA, NAIA, or NJCAA contact-period regulations, which remain your responsibility to know and follow
- Interfere with or disrupt the Service's infrastructure or security, or attempt to circumvent rate limits or access controls
- Use the Service for any unlawful purpose
We may suspend or terminate accounts that violate this section, and may remove content that does.
7. Third-Party Platform Connections (Google & X)
Connecting a Google or X account is optional, is never enabled by default, and can be undone at any time. The Service works fully without it.
If you choose to connect one:
- You authorise UU to send email or direct messages on your behalf, strictly limited to outreach you have composed and approved inside the Service. You remain the sender of record.
- We request the narrowest scopes that make the feature work: for Google, permission to send, and (only if you enable reply tracking) limited message metadata. We do not request permission to read, search, download, modify, or delete anything in your mailbox, and we never access your contacts, calendar, or Drive. Full detail is in Section 6A of the Privacy Policy.
- Our use of Google user data adheres to the Google API Services User Data Policy, including the Limited Use requirements. Data from these APIs is never sold, never used for advertising, and never used to train AI models.
- Your use of connected features is also governed by that platform's own terms: Google's Terms of Service and API policies, and X's Developer Agreement, Developer Policy, and the X Rules. Where a conflict arises, the connected platform's policies govern your account with them, and we may have to disable the relevant feature to stay compliant.
- Consistent with X's automation and spam rules, you agree not to use the X connection to send unsolicited bulk messages, to pay anyone for engagement, or to otherwise breach X's Developer Policy.
- Consistent with the CAN-SPAM Act, any email sent through UU must accurately identify you as the sender and must not use deceptive subject lines or headers. You are responsible for the content of what you send.
- You may disconnect at any time from your account settings, or from the platform's own security settings, which revokes our access immediately.
Abuse of a connected account (bulk unsolicited messaging, impersonation, or anything that puts UU's standing with a platform provider at risk) may result in the connection being disabled or your account suspended.
8. AI-Assisted Drafting
UU uses a third-party AI provider to generate draft outreach messages from information you supply. You should understand:
- Drafts are starting points, not finished communications. They can contain errors, awkward phrasing, or incorrect assumptions.
- You are solely responsible for reviewing, editing, and approving anything before you send it, including confirming that every factual claim about you, your athletic record, and the recipient is accurate.
- Nothing is sent automatically. UU never transmits a message on your behalf.
- UU is not responsible for inaccuracies, tone, or consequences arising from AI-generated content you choose to send without modification.
- We do not use your content to train general-purpose AI models, and our AI provider processes your request only to return your draft.
8. Analytics & No Guarantee of Outcomes
Your dashboard reflects your own outreach activity: messages you recorded as sent, and clicks on tracking links they contained. It does not guarantee coach responses, program interest, scholarship offers, roster spots, or admission outcomes of any kind.
UU does not track email opens. Outreach is sent from your own email client, so no tracking pixel is inserted and no open events are recorded.
Recruiting outcomes depend on many factors outside our control, including your athletic ability, academic profile, timing, and each program's independent evaluation and roster needs. No part of the Service should be understood as a promise of a recruiting result.
9. Intellectual Property
Your content. You retain ownership of the profile content, media, statistics, and information you upload. By posting it, you grant UU a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, and transmit that content as needed to operate the Service: for example, rendering your public athlete profile and including your details in outreach you generate. This licence ends when you delete the content or your account, except for copies already sent to a recipient and for backup copies pending routine deletion. Separately, if you send us a review, testimonial or feedback about the Service, you grant us permission to use it to promote the Service on the terms set out in Section 9A of the Privacy Policy.
Aggregated and anonymised data. We may create statistical, aggregated, or de-identified data from Service activity: for example, how many athletes in a graduation year use a feature. Such data contains no information identifying any individual, is not re-identifiable, and belongs to UU. We do not create biometric templates, kinematic models, or any derived biological profile from your media.
Our content. The Service's software, design, directory compilation, written materials, and branding are owned by UU or our licensors and may not be copied, reverse-engineered, or reused without permission.
Copyright complaints. If you believe content on the Service infringes your copyright, contact support@uncommittedu.com with enough detail to identify the work and its location, and we will respond in accordance with the Digital Millennium Copyright Act.
10. Athlete Profiles and Public Visibility
Some athlete profiles are prepared by UU before the athlete signs up, as described in Section 7A of the Privacy Policy. Until claimed, they are excluded from search-engine indexing and from every public directory on our site, and are reachable only by the direct link sent to that athlete. Any athlete may delete such a profile in one click from that link, without an account and without contacting us.
Once you claim a profile and choose to make it public, it is publicly viewable and may be indexed by search engines: that is its purpose as a recruiting tool. You control that setting and may make your profile private or delete it at any time.
11. Coach & Program Directory Data
Directory information about coaches and programs is licensed from a third-party recruiting-data provider or drawn from publicly available sources, and is provided so you can conduct legitimate recruiting outreach. You may not use it for any other purpose, including resale, unrelated marketing, list-building, or harassment. A coach who wishes to be corrected or removed may write to support@uncommittedu.com.
12. Name, Image and Likeness (NIL)
UU does not broker, facilitate, host, or pay NIL compensation. We are not an NIL collective, agent, marketplace, or booster. Subscription fees flow from you to UU for software; no payment flows from UU to any athlete.
NCAA disclosure obligations apply to compensation an athlete receives. Because UU pays athletes nothing, your use of the Service does not itself create a reportable NIL agreement. You remain responsible for your own eligibility compliance. Your profile information is visible to you in your account at any time, and your public athlete page can be viewed and printed by anyone you share the link with, including a compliance office. If a compliance office requires a record of your activity here, write to support@uncommittedu.com and we will put together the information you have provided to us in a reasonable format and send it to you within a reasonable time.
13. Third-Party Services and Links
The Service relies on third-party providers (listed in the Privacy Policy) and links to third-party sites such as school athletics pages and social media. We do not control those sites and are not responsible for their content, terms, or privacy practices.
14. Termination
We may suspend or terminate your access, with or without notice, for violation of these Terms, non-payment, or conduct that risks harm to UU, other users, coaches, or third parties. Where practical and lawful we will tell you why and give you a chance to respond.
You may stop using the Service and delete your account at any time from account settings. On deletion we remove your profile and account data as described in the Privacy Policy. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution) do survive.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DIRECTORY INFORMATION IS COMPLETE OR CURRENT, OR THAT ANY OUTREACH WILL PRODUCE A RESPONSE, OFFER, OR RECRUITING OUTCOME.
Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UU AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF RECRUITING OPPORTUNITY, SCHOLARSHIP, ROSTER SPOT, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID UU IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS.
Some states do not allow these limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot lawfully be limited.
17. Indemnification
You agree to indemnify and hold UU harmless from claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or content you submit or send through it. If you are a minor, this obligation is accepted by the parent or guardian who agreed to these Terms on your behalf.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law principles.
Informal resolution first. Before filing anything, both parties agree to try to resolve the dispute informally: write to the other party describing the problem and allow 30 days for a response.
Binding arbitration. If that fails, the dispute will be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules (or its Consumer Arbitration Rules where those apply), in King County, Washington, or remotely by agreement. Judgment on the award may be entered in any court with jurisdiction.
Class-action waiver. YOU AND UU AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies.
Exceptions. This section does not apply to (a) claims that qualify for small-claims court, or (b) claims for injunctive relief to protect intellectual property or prevent unauthorised use of the Service, either of which may be brought in the state or federal courts in King County, Washington.
Your right to opt out. You may reject this arbitration agreement and class-action waiver by emailing support@uncommittedu.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Opting out costs you nothing and does not affect your account.
Nothing here prevents you from reporting a concern to a government agency or from exercising any non-waivable right under your state's law.
19. Changes to These Terms
We may update these Terms. Material changes will be posted here with a new "Last Updated" date and, where required by law, communicated to you directly before they take effect. Continued use after that date accepts the updated Terms. If you do not accept them, you may cancel and stop using the Service.
20. General
These Terms, with the Privacy Policy, are the entire agreement between you and UU regarding the Service. If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
